Dear Arjuna,

I came across your website via a Google search for Heli-Beds as I too am experiencing problems with them. My problem regards a new bed which was faulty when delivered, when the replacement also turned out to be faulty.

I demanded my money back instead as I am entitled to under the sale of goods act. They are refusing to do this and are now claiming that there is nothing wrong with my mattress - unstitched, fraying material is being described as "excess cloth". Given your experiences I am not at all confident about the long term future of the mattress and this reinforces my decision to go for a refund. I have dealt with Andrew Pearce and found him to be both surly and evasive, constructing reasons and excuses on an ad hoc basis. I think I may well have to pursue this matter further in the courts. Anyway, I was wondering whether given your experience you have any advice or information that might help me in my efforts. Anything you can provide would be most appreciated - companies like Heli-Beds really cannot be allowed to get away with this sort of behaviour.

A colleague has informed me that a fairly recent EU directive (dating from 1999, incorporated into British law in 2002 - see http://www.opsi.gov.uk/si/si2002/20023045.htm) that provides protections beyond that of the Sale of Goods Act. This may be of interest if you have not come across it yourself. In particular the directive (paragraph 17 of http://europa.eu.int/eur-lex/lex/LexUriServ/LexUriServ.do?uri=CELEX:3199 9L0044:EN:HTML) mentions that Goods must maintain conformity within a period of at least two years and it sounds that your mattress problem comes within this.
